WesTower Communications has sued Nsoros MasTec for breach of contract, claiming that it is owed $1.7 million for labor, materials, services and supplies. WesTower contracted with Nsoros to do tower work for which it said it was not paid.
“Nsoros’ failure and refusal to pay WesTower in a timely manner is without justification and is designed to punish and harm WesTower,” the complaint said.
WesTower asked in its complaint for the principal amount owed plus punitive damages of $5 million.
An agreement for construction services, dated Feb. 7, 2009, between WesTower and Nsoros was presented as evidence. Purchase orders totaling $45.152 and $57,417 for work done in Dover, Fla., were included in attached to the complaint. The POs included 15 sweep tests with climbs, PIM testing, fiber testing, 18 surge protectors for coaxial cable and five ground bars.
